I hereby agree to submit to binding arbitration all disputes and claims arising out of the submission of this application and/or any way relating to my request for employment with the company. Binding arbitration shall be conducted through the American Arbitration Association and pursuant to their rules for employment disputes. I agree and acknowledge that in the event that I am hired by the company, all disputes that cannot be resolved by informal, internal resolution, whether during or after my employment, will be submitted to binding arbitration. I acknowledge that the company's arbitration and alternative dispute resolution agreement apply to me as an applicant to the company. I understand that my signature here confirms acceptance of this agreement in its entirety. I understand that I will be required to sign the full agreement for the company records in the event that I am offered employment with the company, but that I am committing myself to that agreement by signing here at this time. I understand that I have the ability to consult an attorney before signing this agreement if I choose to do so.
After conditional job offer has been made or at any time during my employment, you may be asked to take a drug test to detect the presence of controlled substances.
Employment at this business requires all employees to be fit to perform any physical and/or mental activities related to the essential functions of their jobs, as well as to appear regularly and on time for work as assigned. After an offer of employment is made to you and before you report to work, you may be required to submit to a medical review. Depending on company policy and the requirements of the job, you may be required to be examined by a medical professional chosen by the company.
You should understand that the position for which you are applying is considered at-will, which means that either you or the company can terminate employment for any reason or no reason at any time. No one except the company president has the authority to amend this agreement.
This authorization and consent for release of personal information acknowledge that Tubal-Cain Industries Inc. (Hereafter referred to as "Company") and/or its agent, Secure Search, may now, or at any time I am assigned to, volunteer with or am employed by this Company, conduct investigations whether the records are of public, private or confidential nature. These investigations might include, but are not limited to, searches of educational institutions attended; records of previous employment, including work history, complaints and grievances filed by or against me; records and recollections of attorney-at-law or of other counsel, whether representing me or any other person (in either a civil or criminal case in which I have been involved); criminal history information of file in local, state or federal agencies; and motor vehicle records, and following an employment offer, workers' compensation reports from either the Department of Labor, National Personnel Records or the Industrial Commission or similar agencies under the provisions of the Fair Credit Act 15, USC section 1681 et seq.
I understand that these searches will be used to determine work assignment or employment eligibility under the company's employment or volunteer policies. Therefore, I authorize and consent for full release of records (either orally or in writing) to the authorized representatives of the company. In addition, I release and discharge the company and its agent and associates to the full extent permitted by law from any claims, damages, losses, liabilities, costs expense or any other charge or complaint filed with any agency arising from retrieving and reporting this information. After reading this document, I fully understand its contents and authorize the background verification.
